Monday, August 30, 2010 Attorney General Jack Conway today announced a $3.75 million settlement with drug manufacturer GlaxoSmithKline (GSK) for deceptive or false marketing of the anti-nausea drugs Kytril and Zofran, among others. The settlement follows a January 27, 2010 decision by Franklin Circuit Judge Roger Crittenden to award the Commonwealth more than $5.8 million in civil penalties against GSK for violating Kentucky’s Consumer Protection Act.

Wednesday, August 25, 2010 Governor Steve Beshear announced today that he signed a death warrant for convicted killer Gregory Wilson, setting his execution date for Sept. 16. Wilson’s case is one of three submitted by the Attorney General, but a delay in the production of one of the drugs in the lethal injection protocol has postponed signing the remaining two warrants.

Investigators from General Conway's Cybercrimes Unit arrested Jeremiah North, of Middlesboro, on August 24, 2010 on four counts of possession of matter portraying a sexual performance by a minor.

Tuesday, August 24, 2010 Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control today announced that Sean Brennan, 41, and Kacie Carlson, 25, both caregivers at Community Alternatives of Kentucky (CAKY) in Somerset, have been charged with one count each of Failure to Report Suspected Abuse under KRS 209.030 in Pulaski County District Court. Both Brennan and Carlson reside in Somerset.

Sallee, of Richmond, in Madison County, plead guilty in March 2010 to charges of wanton abuse and neglect of an adult under KRS 209.990.

An Assurance of Voluntary Compliance (AVC) filed Wednesday, July 21 in Franklin Circuit Court requires Outreach to file all of its outstanding financial documents within 10 days. Friday, July 23, 2010 Governor Steve Beshear joined state legislators, local officials and emergency management personnel today to view devastation in Carter County caused by recent flooding. Weather reports indicate as much as six to nine inches of rain fell on parts of northeast Kentucky late Tuesday evening and Wednesday, causing flash flooding, evacuations and water rescues. Preliminary damage assessments are underway in multiple counties affected by severe storms this week.

Inc. to determine whether the company has effectively abandoned its natural gas facilities in Morgan County. Service to Elam’s Morgan County customers is scheduled to end on July 26 because Elam has not fulfilled its contract with the pipeline company from which it draws its gas supply.

Friday, July 09, 2010 The Kentucky Public Service Commission (PSC) today made public the reports from its investigation into Kentucky Power Co. (American Electric Power) after the outages following the December 2009 snow storm in eastern Kentucky. As a result of the investigation, Kentucky Power has agreed to move to regular vegetation clearing cycle in its 20-county service territory. The company has about 176,000 customers in those counties.

An Agreed Order between the Commonwealth of Kentucky and the city of Portsmouth, Ohio, its former mayor Gregory Bauer, Steven Shaffer and David Vetter, dismissing the civil suit, was filed today in federal district court.
- Attorney General's Office Files Motion to Revoke Probation of Former Community Presence Caregiver
Thursday, July 08, 2010 Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control today announced that they have asked Carter Circuit Court to revoke the probation of a former Community Presence caregiver. Last May, Branden Starostka, from Grayson, was sentenced to five years in the Kentucky Department of Corrections for wanton abuse of a vulnerable adult and tampering with physical evidence. Starostka was initially sent to prison, but in October, the court granted his motion for shock probation.

Royse, formerly of Frankfort, was indicted for knowing neglect of an adult under KRS 209.990(2) in connection with the neglect of a resident at Golden Living in December of 2007.

Thursday, July 01, 2010 Attorney General Jack Conway and his Office of Special Prosecutions today announced the indictment of a former Kentucky mine safety analyst from Perry County. A Franklin County grand jury indicted 50-year-old Betty Sue Whitaker of Hazard on 28 counts of tampering with public records following an investigation by General Conway's Department of Criminal Investigations (DCI) and other agencies. The charges carry a maximum penalty of up to 20 years in prison.

- Attorney General Conway Announces Conviction of Berea Man on Child Pornography and Drug Charges
Thursday, June 24, 2010 Attorney General Jack Conway today announced the conviction of a Berea man on child pornography and drug charges. A Madison Circuit Court jury has found Gerald Jones guilty of 143 counts of possession of matter portraying a sexual performance by a minor, one count of marijuana cultivation and one count of possession of drug paraphernalia. Jones will receive the maximum of 20 years to serve on all counts when he is formally sentenced on August 12, 2010.

- Former Madison County Caregivers Charged with Abuse of Mentally Handicapped Victim
Tuesday, June 22, 2010 Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control today announced charges have been filed against two former Madison County caregivers for allegedly abusing a mentally handicapped man in their care. Verna Campbell, a former Assistant Adult Treatment Supervisor at Independent Opportunities in Richmond, KY, is charged with wanton abuse and neglect of an adult under KRS 209.990 in connection with the treatment of a former resident of Independent Opportunities in June of 2009. Independent Opportunities is a group home that houses mentally handicapped adults and children.

A Madison district judge on Monday granted a request from the Attorney General's office that Jaclyn Dawn VanWinkle's conditional discharge be revoked after she pled guilty to both alcohol intoxication in a public place and rape and sodomy in the third degree.
