Two companies cited for polluting Cloverfork River

FRANKFORT, Ky. (Sept. 21, 2005) - The Kentucky Division of Mine Reclamation and Enforcement (DMRE) has cited Dixie Fuel Company, LLC and Harlan Cumberland Coal Co. for discharging muddy water into the Cloverfork River on Sept. 17, 2005.

A citizen’s request for inspection alerted the Frankfort DMRE office to the discharge near the community of Highsplint in Harlan County. DMRE inspection personnel traveled to the area and observed muddy water in the river.

Water samples were taken from two sediment ponds and also at locations on the river above and below the discharge sites. Analysis of those samples revealed that they were high in total suspended solids and had exceeded water quality and effluent limitation standards. Notices of non-compliance were issued to both companies on Sept. 17. A follow-up inspection Sept. 20 showed both permits again in compliance. DMRE is currently assessing civil penalties.
