Fleming County Man Indicted For Distribution And Possession of Child Pornography

Attorney General Jack Conway and his Department of Criminal Investigations have announced the indictment of a Fleming County man on multiple charges of distribution and possession of child pornography.

A Fleming County grand jury indicted James Donovan, 26, of Flemingsburg, on June 2, 2009 on five counts of distribution of matter portraying a sexual performance by a minor, four counts of possession of matter portraying sexual performance by a minor and one count of tampering with physical evidence for allegedly reformatting his computer hard drive after learning that an official investigation involving his computer was ongoing. All are class D felony charges. An arrest warrant has been issued for Donovan.

The investigation preceding the indictment was conducted by the Office of the Attorney General’s Cybercrimes Unit, a member of the Internet Crimes Against Children Task Force (ICAC).  Kathryn Hendrickson, Commonwealth’s Attorney for the 19th Judicial Circuit will be prosecuting the case.

A charge is merely an accusation and a defendant is presumed innocent until and unless proven guilty.
