Tuesday, August 02, 2011 Attorney General Jack Conway today announced that a Logan County grand jury has returned an indictment against a Russellville, Ky. man following an investigation by General Conway's Cybercrimes Unit. The grand jury indicted 48-year-old Roger Cropper on four counts of possession of matter portraying a sexual performance by a minor and one count of distribution of matter portraying a sexual performance by a minor.
- Shelby County Man Sentenced to 121 Months for Possession of Child Pornography
Friday, July 29, 2011 Attorney General Jack Conway today announced a 10 year prison sentence for a Shelby County man following his guilty plea in a child pornography case. Ronald Craig Hornback, 51, was sentenced on July 26 in U.S. District Court to 121 months in federal prison following his guilty plea to one count of receipt of child pornography. Hornback will also be required to register as a sex offender. Prosecution of this case was handled by Erin Roth in the United States Attorney's office for the Eastern District of Kentucky.

Monday, July 25, 2011 Attorney General Jack Conway announced today that his Office of Medicaid Fraud and Abuse Control has filed suit against First DataBank, Inc. (First DataBank) and McKesson Corporation (McKesson) in Franklin Circuit Court. Filed on July 15, 2011, the complaint alleges that McKesson, the nation's largest pharmaceutical wholesaler, and First DataBank, which publishes a compendium that state Medicaid agencies rely on for reported prices used in reimbursement, conspired to inflate the published average wholesale prices (AWPs) for more than 1,800 brand name prescription drug products. The suit alleges that the companies' conduct caused the Kentucky Medicaid program to overpay for the drugs by tens of millions of dollars.

A Letcher County grand jury returned an indictment on Thursday, July 21 against 25-year-old Jonah Tackett on two counts of bribing a witness, two counts of tampering with a witness and three counts of theft by failure to make required disposition of property, all Class D felonies.

Monday, July 18, 2011 Attorney General Jack Conway today announced the indictment of a Marshall County man on four counts of possession of matter portraying a sexual performance by a minor, a Class D felony. A Marshall County grand jury indicted 42-year-old James Todd Hill on July 14 following an investigation by General Conway's Cybercrimes Unit.

Monday, July 18, 2011 Attorney General Jack Conway announced today that the U.S. Attorney's office has filed a civil complaint against an Erlanger nursing home following an investigation by General Conway's Office of Medicaid Fraud and Abuse Control. The U.S. Attorney's office alleges in its lawsuit that Villaspring Healthcare and Rehabilitation, its parent company Carespring Health Care Management and its owner billed Medicaid and Medicaid for services purportedly provided to its residents, despite knowing that the services were so inadequate that they were essentially worthless.

Thursday, July 14, 2011 Attorney General Jack Conway, the U.S. Attorney's Office and the Bureau of Immigration and Customs Enforcement (ICE) jointly announce the sentencing this week of a Leslie County man to 133 months in prison for receiving thousands of child pornographic images. The charges against 42-year-old Michael Caldwell are the result of an investigation by General Conway's Cybercrimes Unit following a referral from ICE.

Friday, July 08, 2011 Attorney General Jack Conway today announced that a repeat child sex offender has been sentenced to nearly 20 years in prison for violating federal child pornography laws. Forty-seven-year-old Sherman Gayle Pike, of Lebanon, Ky., was sentenced yesterday in United States District Court in Louisville to 235 months in prison. The sentencing follows an investigation by General Conway's Cybercrimes Unit.

Humes of Elizabethtown, Ky. was unsealed in the United States District Court in Louisville, Ky. on Friday, July 1, 2011.

Wednesday, June 29, 2011 Attorney General Jack Conway is alerting Kentucky consumers to a resurgence of the "grandparent's scam" targeting senior citizens. General Conway's Office of Consumer Protection has received nearly a dozen complaints this year related to the "grandparent's scam" with victims reporting losses of nearly $40,000. Four of the complaints were received within the last month.

Monday, June 27, 2011 Attorney General Jack Conway and his Office of Special Prosecutions today announced the conviction of a Somerset man on Friday, June 24, 2011 in connection with a scheme to bribe the Commonwealth's Attorney for Pulaski County. Sixty-two-old Walter Creekmore entered a guilty plea to one count of complicity to bribery of a public servant, a Class C felony. Another co-defendant, 64-year-old Everett Hyden pled guilty to the same charge on November 19, 2010. A Pulaski County grand jury indicted Creekmore and Hyden in July 2010.

Thursday, June 23, 2011 Attorney General Jack Conway, joined by 37 other state attorneys general, announced today a $40.75 million settlement with GlaxoSmithkline, LLC (GSK) and SB Pharmco Puerto Rico, Inc. (SB Pharmco) over alleged substandard manufacturing processes. Kentucky's portion of the settlement is $818,194.

Forty-six-year-old Terry Alan Hadley, a Danville photographer, pled guilty on June 16, 2011 to four counts of possession of matter portraying a sexual performance by a minor.

Carter Circuit Judge Rebecca Phillips handed down the sentence today to 55-year-old Robert Thompson of Ironton, Oh.

- Attorney General Conway Announces Agreement with Circle K to Curb Tobacco Sales to Minors
Friday, May 20, 2011 Attorney General Jack Conway announced today that he has joined the attorneys general of 40 other jurisdictions (39 states and the District of Columbia) in an agreement with Circle K Stores, Inc. and Mac's Convenience Stores LLC to enhance efforts to eliminate underage tobacco sales. The agreement, called an Assurance of Voluntary Compliance, covers about 4,000 convenience store operations in 32 states, all of which sell tobacco products. Stores covered by the agreement operate under the names Circle K, Dairymart, and On The Run. There are 91 stores in Kentucky affected by the agreement.

Wednesday, May 18, 2011 Attorney General Jack Conway announced today that his Election Fraud Hotline received six calls between 6 a.m. and 7 p.m. (EDT) during the Primary Election on Tuesday, May 17. Two of the calls dealt with general election fraud complaints, three dealt with procedural questions and one call was a media inquiry. There were no vote-buying allegations. There were 106 calls to the hotline during the Primary Election in 2010.

This brings to 54 the number of counties that have received the eWarrant system under a $3.9 million American Recovery and Reinvestment Act (ARRA) grant awarded to the Office of the Attorney General in 2009. Robert Thompson, 55, of Ironton, Ohio pled guilty today in three separate indictments to two counts of knowingly abusing a vulnerable adult and one count of wanton endangerment 1st degree. Ira Griffith of Mt. Sterling, Ky. pled guilty to a single charge of wantonly neglecting a vulnerable adult.

Tuesday, May 03, 2011 Attorney General Jack Conway today announced the arrest of a Lexington man for possession of child pornography following an undercover investigation. On Monday, May 2, 2011 investigators from General Conway’s Cybercrimes Unit arrested 36-year-old William K. Hainsworth, a registered sex offender, on four counts of possession of matter portraying a sexual performance by a minor, a Class D felony that carries a penalty of one to five years.

Wednesday, April 27, 2011 Attorney General Jack Conway announced today that 47-year-old James Payne of Barren County has been sentenced to seven years in prison following an investigation by General Conway’s Cybercrimes Unit. Payne entered a guilty plea to four counts of possession of matter portraying a sexual performance by a minor, a Class D felony, and was sentenced in Barren Circuit Court on Monday, April 25, 2011. He also faces a $1,000 fine and lifetime registration as a sex offender.

Wednesday, September 29, 2010 Attorney General Jack Conway today announced that Kentucky will participate in a settlement with pharmaceutical manufacturers Schwarz Pharma, Inc. and Schwarz Pharma Manufacturing, Inc., to resolve claims related to the marketing and misrepresentation of the drugs Deponit and Hyoscyamine Sulfate. Under terms of the settlement, Schwarz has agreed to pay a total of $22 million to resolve claims brought by the federal government, Kentucky and other participating states that the drug manufacturer caused false claims to be submitted to the Medicaid program. Kentucky's state and federal portion of the settlement is $321,055, which represents the amount that Kentucky Medicaid expended for prescriptions written as a result of Schwarz's improper marketing practices.

Friday, April 16, 2010 Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control moved today to join a pending lawsuit in federal district court in Boston against drug manufacturer Johnson & Johnson (J&J) of New Brunswick, N.J., and two of its subsidiaries, Ortho-McNeil-Janssen Pharmaceuticals Inc. and Johnson & Johnson Health Care Systems Inc. The lawsuit, made public in January by the U.S. Department of Justice, alleges that these companies paid millions of dollars in kickbacks to Omnicare Inc., the nation's largest pharmacy that specializes in dispensing drugs to nursing home patients. In November 2009, the United States, numerous states, including Kentucky, and Omnicare entered into a $98 million settlement agreement that, among other things, resolved Omnicare's civil liability under the False Claims Act for taking kickbacks from J & J.

Monday, October 19, 2009 Attorney General Jack Conway announced today that Kentucky has joined with other states and the federal government in reaching an agreement with four pharmaceutical companies over allegations they submitted false claims to Medicaid. Mylan Pharmaceuticals, Inc. (MPI), UDL Laboratories, Inc. (UDL), AstraZeneca Pharmaceuticals LP and Ortho McNeil Pharmaceutical, Inc., will pay a total of $124 million to resolve claims that they violated the False Claims Act by failing to pay appropriate rebates for drugs that were paid for by Medicaid. As part of the settlements, the Commonwealth of Kentucky will recover more than $1.6 million in total state and federal dollars. More than $500,000 will go to Kentucky’s Medicaid Program.

Porter today announced the conviction of an online sexual predator arrested during the Attorney General’s sting in Highland Heights, Kentucky in April, 2007. David L. Quist of Ft. Thomas, Kentucky was convicted of one count of attempted unlawful transaction with a minor, a Class C felony, in connection with his solicitation of what he thought was a 13-year-old girl for sex.

The lawsuit, joined by 33 other states and the District of Columbia, charged Barr Pharmaceuticals and Warner Chilcott with antitrust violations that have prevented generic versions of the prescription oral contraceptive Ovcon® from reaching the marketplace.
