Former inspector indicted on theft, official misconduct charges

Louisa, Ky. (Oct. 18, 2006) -- An environmental inspector whom the Environmental and Public Protection Cabinet (EPPC) had moved to terminate has been indicted in Lawrence County on charges of theft by extortion and official misconduct.

Randall D. Smith, of Greenup, allegedly solicited a bribe from a surface mine operator.  The EPPC later began the process of terminating Smith from his position as an environmental inspector III in the Division of Mine Reclamation and Enforcement, Department for Natural Resources. 

Smith was placed on special leave with pay on Sept. 11, the date of the alleged extortion, pending completion of an investigation by the EPPC Office of Inspector General and Kentucky State Police. 

In the course of the investigation, marijuana was found in Smith's state-issued vehicle, and investigators cited him for marijuana possession.  Smith was served on Sept. 28 with a notice of intent to dismiss, effective Oct. 20.  His special leave ended Sept. 29.

"Integrity is absolutely essential in any regulatory enforcement," EPPC Secretary Teresa J. Hill said.  "Our agency acted immediately to investigate a complaint in this case, then to terminate the employment of the individual involved."
