Lawrence County Doctor, Former Pain Clinic Owner, Indicted Following Attorney General's Investigation

Attorney General Jack Conway and his Office of Medicaid Fraud and Abuse Control today announced the indictment of a Louisa, Ky. Anesthesiologist, who is the former owner of two Eastern Kentucky pain clinics. A Lawrence County grand jury today indicted Lee Adam Balaklaw on 20 counts of Medicaid fraud, in violation of KRS 205.8463(1), following an investigation into his billing practices at Anesthesia Associates of Louisa, P.S.C. The charges are Class D felonies.

The indictment alleges that Balaklaw intentionally or wantonly submitted fraudulent and false claims to Medicaid by claiming he treated multiple patients using pain treatment injections into the tendon. These types of injections are called trigger point injections. The charges allege that from January 2007 through July 2010, Balaklaw fraudulently billed $90,000 for the 29 patients included in the indictment.

A warrant has been issued for Balaklaw's arrest and his bond is set at $5,000 cash. An arraignment date will be forthcoming in Lawrence County Circuit Court.

Investigators from Attorney General Conway's Office of Medicaid Fraud and Abuse Control investigated this case and prosecutors from the same Office are handling the prosecution of the case in Lawrence County Circuit Court. The case was referred to the Attorney General's Office by the Department of Medicaid Services.

Since Attorney General Conway took office in January 2008, his Office of Medicaid Fraud and Abuse Control has recovered or been awarded more than $210 million for the state and federal Medicaid programs. These cases range from lawsuits and settlements against pharmaceutical companies to cases against individual providers.

A charge is an allegation only. All defendants are innocent until proven guilty.
