Attorney General Greg Stumbo Announces Refund Payments for J.D. Byrider Consumers
Attorney General Greg Stumbo today announced that more than 2,500 used car buyers will receive refund checks of up to $500 from the Office of the Attorney General as part of a consumer protection settlement with the former J.D. Byrider automobile franchise in Louisville. The Office of the Attorney General just received the final payment owed under the settlement agreement.
Individual refund checks of up to $500 are being mailed today to consumers. To date more than 7,350 consumers have received restitution totaling nearly $3.7 million. The former J.D. Byrider Louisville franchise issued more than $2 million in account credits to consumers with loan balances who filed claims with the Attorney General by May 31, 2006.
Additional consumer checks will be issued by the Office of the Attorney General in upcoming weeks, including checks to as many as 2,003 eligible consumers who paid their loan balance and who respond to a letter and claim form mailed last month through the IRS’s Project 753 mailing service. This specialized service is designed to reach out to consumers who could not be otherwise located. The deadline for responding to the Project 753 letter is February 28, 2007.
The Attorney General’s Office of Consumer Protection filed suit in December 2004 against the J.D. Byrider Louisville franchise and corporate franchisor J.D. Byrider Systems Inc. of Carmel, Indiana. The lawsuit alleged numerous violations of the Kentucky Consumer Protection Act and sought relief for customers.
A settlement of the suit was reached in February, 2005 requiring $500 in restitution for each consumer who purchased a vehicle at the Louisville J.D. Byrider from January 1, 2000 to December 31, 2004. Restitution is being accomplished through account credits issued by the Louisville J.D. Byrider for loans with outstanding balances or refunds of $500 per consumer per vehicle for loans that were paid in full. The Office of the Attorney General contacted affected consumers through several mailings as well as radio, television, billboard and print advertising.
“My office has worked diligently to recover this money for hard-working consumers who fell victim to J.D. Byrider’s unscrupulous business practices,” Stumbo said. “I will continue to fight for the rights of individuals who are taken advantage of by big business.”
